| No. The Colombian Administration regulated the exploitation and operation of GMPCS systems through Resolution No. 3610 of July 28, 1997. Account was taken of the principles set forth the Memorandum. |

La Administración o autoridad competente de su país ha informado al Secretario General de la UIT sobre la intención de la misma de implementar los acuerdos de los sistemas GMPCS en lo referente a la homologación de los terminales, la licencia, la marca, las disposiciones arancelarias y el acceso a la información de tráfico?. Has your Administration/Competent Authority informed the ITU Secretary-General of its intention to implement the GMPCS Arrangements with regard to terminal type approval, licensing, marking, customs arrangements, and access to traffic data? |
| Resolution. No. 3610 of 1997, Article 15,
establishes the requirements for terminal type approval.
Article 15. Requirements for type approval. User terminals for low and medium-orbit satellite systems, including stratospheric platforms, require type approval certificates, which shall be issued by the Ministry of Communications upon presentation of a certificate from the government agency that notified the global system or the equipment manufacturer that the user terminals conform to the technical standards of the most suitable system meeting such standards.

Aun cuando la Administración o autoridad competente de su país haya decidido no firmar el Memorándum de Entendimiento o haya notificado a la UIT sus intenciones de no implementar los acuerdos ¿está permitida la circulación entre fronteras de los terminales del sistema GMPCS para el tránsito o uso personal?. If your Administration/Competent Authority has decided to not sign the GMPCS MoU or has notified the ITU of its intention not to implement the Arrangements, does it permit the trans-border circulation of GMPCS terminals for transit or personal use? |

Comments: There are no provisions for the unhindered circulation of terminals in Colombia. Resolution 3610 of 1997, Article 16, establishes the Requirements for the unhindered circulation of terminals. Resolution 3610 of 1997, Article 16: Requirements for the unhindered circulation of terminals. Suppliers shall be responsible for providing any information required by the Ministry of Communications for authorization of the unhindered circulation of user terminals in Colombia. For purposes of consultation by the competent authorities, the supplier shall set up a computer files containing information identifying persons authorized to carry user terminals. These files shall be stored in the ROM memory of the terminal equipment or in a database that may be consulted therefrom in real time, or any other practical method may be utilized for these purposes. The identification record shall contain the user’s name and identity document number, and the serial number of the apparatus. |

Como parte del proceso de implementación del sistema GMPCS, el Secretario General de la uit envía cartas sobre la implementación específica de estos sistemas a las Administraciones o autoridades competentes y en ellas señala los sistemas que han cumplido con los requisitos del Memorándum de Entendimiento del sistema GMPCS con referencia a la aprobación de los terminales del mismo. Se insta a las Administraciones responder a estas cartas sobre la implementación específica de estos sistemas para establecer si el país respectivo permite, o no, la entrada de los terminales asociados y si existe cualquier restricción relativa al tránsito o uso de los mismos. Favor proporcionar un informe de avance con relación a su respuesta a las siguientes cartas y a cualquier condición que haya sido impuesta. As part of the GMPCS implementation process, the ITU Secretary-General sends to Administrations/Competent Authorities specific system implementation letters indicating systems that have met the GMPCS MoU requirements regarding approval of their terminals. Administrations are strongly urged to respond to these system specific implementation letters to indicate whether these terminals are allowed into the country and any restrictions for their transit or use. Please provide below information on the status of your response to the following letters and any conditions imposed. |
